The Haryana Government has framed and notified rules under the Maternity Benefit (Amended) Act, 2017, for providing crèche facilities and amenities in such establishments as employ 50 or more employees in the state.

  • Chandigarh August 2—The Haryana Government has framed and notified rules under the Maternity Benefit (Amended) Act, 2017, for providing crèche facilities and amenities in such establishments as employ 50 or more employees in the state. With this, crèche facility would be available to the children of regular, temporary, daily wagers, contractual, consultant and other such employees.
  • Stating this here today, a spokesman of the Labour Department said a proposal to this effect had been approved by the Chief Minister, Mr Manohar Lal.
  • Now, every establishment in the state having 50 or more employees, would have to maintain the facility of crèche in the vicinity of the place of work or within a walkable distance, that is 500 meters, from the entrance gate of the establishment, for use of children of such employees under the age of six years.
  • The building in which creche is situated would be soundly constructed and all walls and roof would be of heat-resistant materials and waterproof. The floor and internal walls of the crèche would be so laid or finished as to provide smooth impervious surface.
  • Also, the building of the crèche would be so constructed as to afford adequate protection against heat, damp, wind and rain. While the interior walls would be lime-washed once in six months, the wood work would be painted or varnished once every three years.
  • The spokesman said the creche would have a minimum space of 6-8 sq. ft. per child to ensure that they can play, rest and learn without any hindrance. Apart from this, the height of the rooms in the building would be not less than 12 feet from the floor to the lowest part of the roof.
  • Effective and suitable provision would be made in every part of the crèche for securing and maintaining adequate ventilation by circulation of fresh air. There would also be provision for sufficient and suitable natural or artificial lighting connected with emergency power back-up.
  • He said the crèche would be provided with a closed wash-room, with separate space for washing and drying soiled clothes or bed linen. Besides, adjoining the wash room, latrine and urinal would also be provided. The crèche would remain open all times, both in day and night when employees are working in the establishment, he added.
  • The spokesman said certain amenities would be provided in the crèche. These include first aid and medicine kit, cradles, cot with bedding cooking facilities, cooking utensils, utensils to feed the children, chair or sitting accommodation for use of each mother for  feeding or attending to her child, toys or play materials and teaching or learning materials.
  • He said that wholesome drinking water and pure milk would be made available for each child who is accommodated in the crèche. However, for children above two years of age wholesome refreshment would also be provided.
  • Sufficient and adequate crèche staff--female attendant, cook, sweeper and chowkidar--would be employed for attending to children in the crèche. A trained crèche-nurse would be appointed crèche in-­charge who would ensure that the creche is kept in a clean and sanitary condition, that all children attending it are properly looked after, washed and fed in accordance with the provision of these rules and that they are taught clean and healthy habits.
  • A monthly medical examination of children attending the crèche and that of nursing mothers every two months would be made by a qualified medical practitioner. Records of such examinations would also be made.
  • The spokesman said record of particulars of children attending a creche would be maintained. Apart from this, a register of complaint would be kept in the crèche provided the chief inspector is satisfied that by any reason, the employer is unable to provide within the stipulated period a crèche in accordance with the specifications.
